By booking with Serenity Sand & Seas Travel LLC you agree to the following terms & conditions

These Terms and Conditions (“Terms”) become effective between Serenity Sand & Seas Travel LLC (“Agency”) and you (including all travelers on the same booking) (“you” or “Traveler”) upon your signature (electronic or written) or payment authorization until terminated in writing by you or Agency.

These Terms are subject to change at any time, without prior written notice. The effective version of these Terms is located at https://serenitysandseastravel.com/terms-condition.


DEFINITIONS
“Agency” means Serenity Sand & Seas Travel LLC.
“Booking Services” means travel reservation and booking services provided to you by Agency.
“Lead Traveler” means you, acting on behalf of all Travelers on the same booking.
“Supplier” means any party who provides Travel Services to Travelers.
“Terms” means these Terms and Conditions.
“Traveler” means you and all Travelers on the same travel booking.
“Travel Services” means travel products and services provided to you by Suppliers, including hotel accommodations, air transportation, cruises, car rentals, tours, activities, and similar products and services involving any type of leisure, business, or other travel.

TRAVELERS
  • You are the Lead Traveler, representing all Travelers on the same booking.
  • You are responsible for:
  • o Sharing these Terms with all Travelers; and
  • o Providing to Agency written confirmation that all Travelers agree to these Terms.
  • You are responsible for understanding these Terms—please read them carefully before accepting Booking Services or Travel Services.
  • If you do not understand any part of these Terms, please: (1) confer with your legal counsel; and (2) contact Agency in writing to request clarification.
  • You acknowledge receipt of Agency’s Travel Services Agreement, which refers to these Terms.


AGENCY
  • Agency is a travel agent who provides Booking Services to you.
SUPPLIERS
  • Suppliers are independent companies who provide Travel Services to you.
  • Suppliers operate under their own terms, conditions, and management.
  • Your travel documentation identifies each Supplier responsible for providing your Travel Services.
  • By paying for Travel Services, you consent to the use of those Suppliers.
  • All documentation, receipts, confirmations, and tickets issued are subject to the terms and conditions specified by the Supplier.
  • Please read Supplier terms and conditions carefully. You are responsible for understanding and adhering to terms imposed by any Supplier with whom you elect to deal, including, without limitation, payment of all amounts when due and compliance with Supplier’s rules and restrictions regarding availability and use of Travel Services.
  • You understand that any violation of any such Supplier’s terms may result in denied access to Travel Services, cancellation of reservations, and forfeiture of any monies paid. If any such violation results in fees or penalties to Agency, you agree to cover such actual costs.
  • Suppliers may require you to sign a liability waiver prior to participating in their Travel Services.
  • Suppliers are not subject to Agency’s control—they are not employees, agents, representatives, or affiliates of Agency.
  • Agency is not responsible for any Supplier’s breach of contract, failure to comply with any laws, or willful or negligent acts or omissions, which may result in delay, inconvenience, costs, loss, damage, injury, or death to Travelers or Travelers’ companions.
  • If a Supplier declares bankruptcy, it is not obligated to transport you or to provide refunds. It might continue to provide some or all Travel Services, or it may stop operations completely.
  • Other Suppliers may, but are not required to, provide alternative Travel Services.
  • Payments to Agency immediately become the property of Suppliers, as required by law.
  • Agency is not permitted to provide refunds for Suppliers who have declared bankruptcy.
  • Agency has no special knowledge about the financial condition of Suppliers, and Agency has no liability for recommending a trip credit or a refund.

RATES & INCLUSIONS
  • Quoted rates are based on the precise inclusions Agency will provide to you in writing.
  • Unless specifically itemized on your travel documentation, rates do not include Travelers’ costs, fees, or taxes incurred for or related to:
  • Airports, ports, stations, security, agriculture, customs, immigration, visas, passports, or any other government-imposed taxes or fees, without limitation; or
  • Meals, beverages, alcohol, minibars, entertainment, seat assignments, upgrades, excursions, hospitality, gratuities, copies, telecommunications, energy, laundry, cleaning, bedding, parking, valet, insurance, taxis, transfers, porterage, departures, travel segments, health, medical tests or treatment, vaccinations, pharmaceuticals, supplements, or any miscellaneous charges of a personal nature, without limitation.

PERSONAL INFORMATION
  • You consent to Agency and Supplier use of your personal information.
  • You understand that, as part of booking any Travel Services, certain personal information may be conveyed to third parties to accommodate your travel.
  • Such information includes birth dates, passport numbers, travel dates, occupation, frequent flyer information, bank accounts, credit cards, and other information needed to secure travel arrangements.
  • Agency will not be liable for the distribution of your information to any Supplier.
  • Our liability for the failure of any foreign Supplier to protect your personal information is specifically excluded.
  • You authorize Agency to keep your personal information for as long as needed to provide Booking Services and for a reasonable period thereafter for Agency’s legal or business purposes

GROUPS
  • Terms for groups will differ from Flexible Independent Traveler (FIT) guidelines.
  • For details, see your “Group Sales Contract.”


RESERVATIONS & PAYMENT
  • You authorize Agency to charge your credit card, debit card, or other means of payment for the charges associated with your travel booking.
  • By authorizing Agency to charge your means of payment through Agency’s payment authorization platform, written documentation, or by phone, you understand and agree to these Terms, including, without limitation, all cancellation policies.
  • Traveler payments to Agency in currency other than U.S. Dollars (USD) will be converted at then-current exchange rates.
  • Agency payments to Suppliers will be converted at then-current exchange rates between USD and the currency in Supplier’s country.
  • A purchase is not complete until all deposits and other amounts due have been processed and a booking confirmation has been provided to you in writing.
  • All deposits are non-refundable and non-transferrable. All reservations (except where specified) will require a deposit and will be clearly noted the amount due and monthly payment plan.
  • If payments are not received by their due date, all components of the booking may be cancelled by the Supplier, which may result in NON-REFUNDABLE previous payments.
  • Agency is not responsible for Supplier fare increases, fees, or penalties incurred due to late payment, all of which must be paid by you.
  • Agency reserves the right to cancel your booking if Agency does not receive full payment for Booking Services or Travel Services within a reasonable time, in Agency’s sole discretion.
  • If rebooking is requested, Agency will assist with obtaining any refunds due to rebooking trips (e.g., using future cruise credits), but Agency may, in its sole discretion, charge a NON-REFUNDABLE FEE for that Booking Service.
  • In the event that there is a need to extend your final payment date, please let us know as early as possible and we will attempt to obtain an extension on your behalf from our suppliers. Please note that extensions are either granted or denied by our suppliers on a case by case basis and are NOT guaranteed. Your reservation will still be subject to cancellation until you are informed otherwise. These payments must be received in full 90 - 60 days before travel.

CHANGES & CANCELLATIONS
  • You agree to adhere to the terms and conditions of Suppliers regarding your travel reservations or bookings and you agree to pay any applicable change or cancellation fees.
  • If you change or cancel a reservation or booking, you may be subject to:
  • Agency fees of USD $150 per person; AND
  • Supplier fees, charges, or penalties.
  • NO REFUNDS will apply to any cancelled, unused, or partially used Travel Service.
  • Hotels may not permit changes to or cancellation of reservations, subject to the terms and conditions of the hotel reservation.
  • Notwithstanding the above, you agree to the following cancellation policies of Agency:
  • Cancellation penalties will apply and unless otherwise noted if your trip is within 75 days it is 100% non-refundable.
  • Failure to make your final payment on time may result in the cancellation of your reservation WITHOUT refund.
  • Please note wedding group terms may override this term. If so, the trip is 100% non-refundable after the final payment date of the group as stipulated in said group/wedding.
  • Once reservations have been made, cancellations will only be accepted in writing.
  • Final payments not received prior to the due date above will incur a $50 per person late fee. All reservations are subject to cancellation and hotel penalties as described above if the final payment is not received on the due date. Late fees are not covered by travel insurance and are always non-refundable. All the above would be protected with the optional Travel Insurance with the exception of late fees. If you do not have insurance – natural disasters (such as hurricanes), cancellations for ANY reason (medical/personal emergencies, cancellation of the wedding, etc.) do not relieve you from these penalties. ONLY Travel Insurance will ensure your coverage. All cancellations must be received in writing.

RESERVATION CHANGES
  • ANY changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change.
  • Changes to an existing reservation, whatever the cause, will incur a $75 per person charge plus any additional supplier fees. This includes name changes* and removal of any services such as optional tours and transfers. *Please note that name changes to airline reservations are subject to full cancellation and rebooking. Replacing a traveling passenger with another traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Changes policy.
  • Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show’, which could result in extra charges and/or your flight itinerary being cancelled and/or render your ticket void. There are no refunds for unused services.

NO SHOWS
  • Failure to travel or show up for any reservation or booking is considered a “no show.”
  • No show penalties will be up to the entire cost of travel, subject to terms and conditions of Supplier and Agency policies.


REFUNDS, CHARGEBACKS, AND ADJUSTMENTS

  • Any claim for refund or adjustment must be sent to Agency in writing.
  • Full details and proof of payment documentation must accompany all claims.
  • You may not be entitled to a refund if you change or cancel your travel plans after: (1) a confirmation of the booking; or (2) payment of a booking.
  • Refunds are subject to Supplier terms and conditions.
  • Suppliers may not issue refunds for cancellation due to actual, threatened, or fear of potential terrorist events, political unrest, pandemic or health concerns, or similar circumstances. Please carefully review Supplier terms and conditions.
  • You waive any right to a chargeback in case of trip delays, changes, or cancellation (except for fraud) including any Force Majeure event (as described below).
  • If you attempt a chargeback, reverse charge, or recollection of a travel payment already made without Agency’s authorization, Agency has the right to charge you additional costs, fees, and expenses associated with such chargeback, reverse charge, or recollection, including, without limitation, attorney fees.


STATE OF CALIFORNIA

  • If travel services or transportation is cancelled and the traveler is not a fault and has not cancelled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the traveler, all monies paid to the seller of travel for services not provided will be promptly paid to the traveler, unless traveler advises seller of travel in writing after cancellation.
  • In California, this provision does not apply where the seller of travel has remitted payment to another registered wholesale seller of travel or a carrier without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed upon transportation or service. In this situation, the seller of travel must provide the traveler with a written statement accompanied by bank records to establish the disbursement of the payment and if disbursed to a wholesale seller of travel, proof of that wholesaler’s current registration.
  • Seller of Travel Disclosures: State of California law requires certain sellers of travel to have a trust account or bond.
  • Serenity Sand & Seas Travel LLC has a trust account with Truist Bank.
  • This transaction is covered by the TRCF if the seller of travel was registered and participating in the TCRF at the time of the sale and the traveler is located in the State of California at the time of payment.
  • Eligible travelers may file a claim with the TCRF if the traveler is owed a refund of more than $300 for the transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required.
  • For complete, up to date information regarding your rights under California law, please visit https://tcrcinfo.org. If you are purchasing from outside of California, this transaction is not covered by the California Travel Restitution Fund.


TRAVELER IDENTIFICATION & PROOF OF CITIZENSHIP

The Transportation Security Administration (TSA) requires all airline passengers to provide:
o Secure Flight Passenger Data (SFPD);
o Full name as it appears on government-issued identification;
o Date of birth;
o Gender; and
o Redress number (if available).
  • The name of Travelers on all reservations and travel documents must match the name as it appears on that Traveler’s government-issued identification.
  • Traveler is responsible for any fees and expenses that may be incurred due to an incorrect name or the denial of travel resulting from incorrect information.
  • Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. Agency highly recommends that Travelers check this website well before travel.
  • All U.S. citizens traveling to or from any international destination must have a valid passport, which must be valid for at least six months beyond Traveler’s date of return.
  • Travelers are responsible to confirm current entry and exit requirements and to obtain the necessary travel documentation based on the country of origin, destination, and stops in any additional countries.
  • Minors of age 17 and under traveling alone or with a single parent may be required to have additional documentation on domestic or international flights.
  • NO REFUND will be issued for any costs or losses incurred as a result of Traveler’s failure to obtain or provide required travel documentation.

HONEYMOON & ANNIVERSARY TRAVELERS: You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photocopy is recommended). Failure to have such proof of marriage will result in the resort denying these complimentary privileges (if applicable). PLEASE notify your Serenity Sand & Seas Travel, LLC agent if you are celebrating a Honeymoon or Anniversary so that they can annotate this in your reservation. Typically resort will honor these packages up to 30 days before or after your honeymoon/anniversary date.

Travel Documents. Provided full payment is received no later than your Final Payment Due date, travel documents and travel instructions will be sent via email and/or mail 30 days or earlier prior to travel. If paper documents are requested when e-documents are available, documents will be delivered via USPS approximately 14-21 days prior, and a fee of $30 will apply. A complete street address is required (no PO boxes).

CANCEL FOR ANY REASON TRAVEL INSURANCE: Cancel for Any Reason Insurance can only be purchased at the time your reservation is made; it cannot be added after the initial trip deposit is received. Cancel for Any Reason Insurance starts from $64 to $194 per adult, $50 per child (2 to 12yrs of age at time of travel). Your Serenity Sand & Seas Travel, LLC Agent will quote your insurance policy cost upon initial trip quote. Cancel for Any Reason Insurance will allow you to cancel for any reason up to the morning of departure (prior to flight departure) with a full refund (minus insurance policy cost), provides up to $800 per person baggage loss, up to $100 per person trip delay or interruption (weather & mechanical reasons) & up to $5k per person medical expenses (secondary policy). Insurance does NOT cover items you purchase outside Serenity Sand & Seas Travel, LLC (i.e. airfare, tours, excursions, etc) unless the cost is added to the policy. Please Note: if you initially reserve a room only package & add airfare to the package through Serenity Sand & Seas Travel, LLC at a later date your cancel for any reason insurance policy cost will be adjusted to accommodate the revised total trip package cost at that time. This plan does not include increased rates associated with a change in the number of individuals occupying a room. If the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate. Get a quote and purchase travel insurance here or contact your preferred insurance carrier.

Post Departure Assistance. If you experience any difficulties during your vacation, please inform the relevant supplier (e.g. guest services) immediately. Should they be unable to resolve the matter, please immediately contact us: (984) 226-4479 and we will do our very best to resolve the issue on your behalf.

DISABILITIES & SPECIAL NEEDS

  • If you have disabilities or special needs that may require non-emergency special services, additional support, or disability accommodations, please advise Agency in advance of booking.
  • If you are unable to use your own wheelchairs, mobility devices, or other medical equipment or devices, rentals may be available, potentially subject to additional charges.
  • Airlines and other Suppliers may impose charges for additional baggage and may have size restrictions for wheelchairs they can accommodate.
  • If you travel with a service animal or emotional support animal, Suppliers may require advance arrangements and documentation regarding the animal’s health, training, and related factors.
  • Countries outside the United States and Canada often apply different laws, rules, regulations, standards, and accommodations for persons with disabilities or special needs.
  • Travel destinations may have limited medical facilities, limited availability of prescription medications, and limited means to accommodate your disability or special needs.
  • Please consult your health provider prior to planning or booking your travel.
  • Travel insurance plans may provide access to emergency medical care, medical evacuation, and replacement of prescription medications. Agency strongly recommends the purchase of comprehensive travel insurance.
  • Agency will make all reasonable efforts to request assistance or arrange for appropriate services or equipment regarding Traveler disabilities or special needs. However, Agency is not responsible for the failure of Suppliers to meet Traveler needs and expectations.

 AIR TRAVEL

  • Most airlines consider a name-change to be a cancellation.
  • You are responsible for excess baggage fees. Travelers are responsible to confirm airline baggage allowances for all flights.
  • International flights may have different requirements than domestic flights.
  • Tickets of any kind are payable in full at the time of booking.
  • Airline tickets, once purchased, may be NON-REFUNDABLE and NON-EXCHANGEABLE, subject to airline terms and conditions.
  • Agency is not responsible for any loss, accident, injury, delay, defect, omission, or irregularity that may occur, such as changes, additional expenses, and cancellations due to weather conditions, schedule changes, and other changes beyond Agency’s control.
  • You agree to adhere to safety guidelines of all airlines and hold Agency harmless from any liability due to airline restrictions.
  • Airline seat assignments are not complimentary on every airline.
  • Charges for pre-assigned seats in advance of flight time may be subject to additional charges.
  • Agency cannot guarantee seats in specific locations or next to each other. Seat assignments are strictly based on availability at the time seats are being selected and paid for.
  • Airlines retain the right to change aircraft and seat assignments at any time.
  • Agency is not responsible for any changes made by airlines or any additional charges imposed by airlines for any changes to seat assignments after selection and payment.

Airline Frequent Flier Programs: Passengers are responsible to contact their airline directly regarding mileage eligibility and accrual. Airline frequent flier programs determine whether to award miles in part or total based on their own rules which are updated frequently. Some discounted or promotional airfares as well as some code-share flights are not eligible for mileage accrual. Some private airfares, such as a "Serenity Sand & Seas Travel Airfare", are not eligible for mileage or may qualify for reduced mileage, even if the same airline class of service is eligible for full mileage when sold as an "Instant Purchase" published airfare. Not all published airfares are eligible for mileage. Serenity Sand & Seas Travel will record frequent flier numbers when provided by the passenger prior to travel documents being issued. However, the addition of frequent flier numbers to airline records does not guarantee mileage eligibility which is at the sole discretion of each airline. Airline schedule changes may result in flights which were originally eligible for mileage accrual no longer being eligible. We highly recommend passengers to provide their frequent flier account information whenever checking in online and/or at the airport check-in desk. After travel has commenced, it is often not possible to apply for frequent mileage credit. Passengers are also responsible to determine whether previously earned mileage may be applied to flights to secure upgrades.

Contact Information: Pursuant to TSA Secure Flight requirements, passengers are responsible to provide Serenity Sand & Seas Travel with their name as it appears on their passport (or other government-issued I.D. when traveling), date of birth, gender, address, phone number, email and fax data for all passengers. Passengers must ensure that names are correctly listed on their invoice. Serenity Sand & Seas Travel will not be responsible for passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information.

Airline Taxes & Fuel Surcharges: If you purchased airfare, airline taxes and fuel surcharges are included. Prior to completion of full payment there is a potential for a price increase(s) due to increases in government- levied taxes and fees and/or fuel surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued. Once issued, airline tickets are no longer subject to potential increases but are fully nonrefundable. Certain overseas domestic flights are subject to air taxes which can only be paid locally; in these cases, the specific flights and amounts of those taxes are indicated in our package presentation and pre-departure documentation. ________________________________________

Schedule Changes: In the event of an airline schedule change, Serenity Sand & Seas Travel will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. Serenity Sand & Seas Travel is not responsible for schedule changes including, when applicable, changes in routing and/or the number of stops in the itinerary. Serenity Sand & Seas Travel is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airline, it is the passengers' responsibility to advise Serenity Sand & Seas Travel of amended flight details in writing at info@serenitysandseastravel.com. Serenity Sand & Seas Travel cannot be held responsible for land services, including arrival and/or departure transfers, if flights are changed without its knowledge.

HAZARDOUS MATERIALS & INSECTICIDES

  • All air passengers are prohibited by federal law from bringing hazardous materials aboard aircraft in their luggage or on their person. Violations can result in up to 10 years of imprisonment and significant fines under 49 U.S.C. 5124 (see https://www.govinfo.gov/content/pkg/USCODE-2009-title49/pdf/USCODE-2009-title49-subtitleIII-chap51-sec5124.pdf).
  • Examples include, without limitation, explosives, compressed gases, flammable fluids and solids, oxidizers, poisons, corrosives, radioactive materials, paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.
  • Special exceptions apply for small quantities (up to 70 ounces total) of medical and toilet articles carried in your luggage and certain smoking materials on your person.
  • Restrictions on hazardous materials are listed at:https://www.tsa.gov/travel/security-screening/whatcanibring/all.
  • Some foreign airports require airlines to treat passenger cabins with insecticides prior to or during flights. The U.S. Department of Transportation (DOT) provides a list of such requirements at: https://www.transportation.gov/airconsumer/spray.
  • You are responsible for understanding and adhering to all requirements regarding hazardous materials and insecticides.
  • Please contact your airline regarding your itinerary and applicable rules.

ACCOMMODATIONS

  • Hotel accommodation is subject to availability at the time of reservation.
  • Some hotels require NON-REFUNDABLE and NON-TRANSFERABLE deposits to guarantee a booking. In such cases, Agency will notify you regarding the NON-REFUNDABLE pre-payment for that portion of your travel.
  • Amenities such as elevators, air conditioning, bedding size, and similar preferences are not guaranteed at all properties. In addition, even if a property has amenities such as air conditioning or elevators, such amenities are not guaranteed to be operational or available during your stay.
  • Reimbursement for lack of amenities is solely the responsibility of the hotel. Agency may elect to act as an intermediary, but it is not responsible for such reimbursement under any circumstances.
  • All rooms requested are standard twin-bedded (two single beds) rooms with private facilities, unless you have specifically requested a king/double size bed. Please understand although we will make a bed type request on your behalf, bed types are subject to availability. Room selection in all cases is strictly at the discretion of the hotel's management on a run-of-house basis. Triple and quad occupancy rooms consist of two beds for cruises, where triple and quad rooms will consist a twin bed for each person. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. Although available at most 4 and 5 star hotels, use of air-conditioning abroad differs greatly from the United States. Many European hotels were built before central air-conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months.
  • All hotel rates are based on Serenity Sand & Seas Travel’s agreements with its suppliers and are not negotiable.
  • Hotel check-in time is generally not before 3:00 p.m. and check-out time is prior to noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late-night flight is being used. If a day room is included in the itinerary, check-out will normally be 6:00 p.m. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.


Hotel & Cruise Profiles: Serenity Sand & Seas Travel's hotel and cruise ship profiles are based upon information provided to Serenity Sand & Seas Travel by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. Star-ratings may differ from country to country. Serenity Sand & Seas Travel does its best to maintain current information, however is not responsible for any inaccuracies, changes in description details or amenities, or images provided by third parties.

Meals: As specified in each itinerary. Meals are based on the hotel's or restaurant's buffet or set menu. In general, beverages are not included, unless specifically stated. Although Serenity Sand & Seas Travel cannot make guarantees, every effort will be made to honor special dietary requests submitted in writing at least 4 weeks prior to departure by email: info@serenitysandseastravel.com ________________________________________

Transfers: Transfers are provided as indicated for each tour by car, minibus, or motor coach provided airfare is purchased from Serenity Sand & Seas Travel. If you purchase a land-only tour, or if you deviate from the arrival and/or departure dates as stated in the itinerary, you will have the responsibility to purchase your own transfer to the hotel or by written request. Your arrival transfer is guaranteed for up to one hour from your scheduled arrival time in order to compensate for minor delays. Serenity Sand & Seas Travel or the transfer company will not be responsible for flight delays, for any reason, beyond one hour from your originally scheduled arrival time. In case of a delay, whether due to flight delay, immigration and customs, or time spent reporting baggage damage or loss, it will be your responsibility to make other transfer arrangements such as a taxi. Transfer costs are not refundable and any additional expenses will be your responsibility. The cost of a transfer is more expensive than hiring a taxi, as a Serenity Sand & Seas Travel transfer necessarily includes round trip service, or 'dead-leg', meaning that our driver must come to the airport, hotel or pier only to pick you up and necessarily loses a one-way fare. Often the places of call (airports, seaports, hotels) demand entrance and parking fees, where drivers may have to wait for up to an hour. Serenity Sand & Seas Travel transfer drivers, while not employees of Serenity Sand & Seas Travel, are reliable. They provide you with a full welcome service, transfer you to the correct location and are prepared to answer your questions along your ride. Passengers comfortable hiring a taxi on their own and do not require assistance will save money.

Sightseeing & Itinerary: Will be operated by motor-vehicle, its size dictated by the number of participants. Serenity Sand & Seas Travel tours have been designed to accommodate individuals as well as groups. Times listed in itineraries are approximate and meant only as guidelines. Some itineraries may have early morning start times for sightseeing in order to complete the touring during daylight hours or avoid afternoon heat in tropical and desert climates. It is your responsibility to arrive on time for all scheduled flights, cruises, and package components. Arriving late may be considered a "no-show", in which case you will not be eligible for refund for the unused service(s). We cannot guarantee the number of passengers who will be on any given tour. You may find that you are traveling with a sizeable group or only with your own companions. Services, however, will remain constant no matter the number of tour participants. Persons requiring any assistance or who have any form of disability should refer to section "Travelers With Disabilities". On dates including, but not limited to religious holidays and national celebrations, some monuments and sites may be closed. On these occasions, touring itineraries may be amended to reflect these closures. Occasionally, during holidays and certain periods, and/or due to unforeseen circumstances including weather conditions there may be last-minute changes, sometimes after arrival, in affecting the sequence of the tour, locations visited and/or hotels. Therefore, we reserve the right to adjust the sequence and/or substitute any hotels with others of similar category. In such cases there will be no cost adjustment. National monuments and tourist sites regularly undergo renovations, which can obscure the monument's view. No tour will be canceled due to renovations, however Serenity Sand & Seas Travel will decide based on the conditions whether to amend an itinerary. Serenity Sand & Seas Travel itineraries may contain suggestions for activities for your leisure time; these suggestions do not constitute an endorsement of any specific service provider and the decision to participate in any such activities should be made independently and with due consideration. ________________________________________

Rail: Once full payment is received, Serenity Sand & Seas Travel will select train times, rail tickets will be issued and are fully non-refundable. Except where requested in writing prior to final payment. Passengers traveling with a group may not request alternative train times. Once issued, rail tickets are valid for the dates and times specified. Some exchanges must be done locally at the station due to fare restrictions. Changes may be subject to local charges, fees, and fare increases. Once the booked train has departed, changes are no longer possible nor can amendments be completed on board the train. Serenity Sand & Seas Travel does not control seat assignments which are entirely at the discretion of the rail companies. Once rail tickets are issued they are fully non-refundable and non-changeable.

Group Harmony: To ensure the desired group synergy, Serenity Sand & Seas Travel reserves the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, individuals who are intoxicated and/or under the influence of drugs leading to a negative experience for the remainder of the group. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will necessarily be borne by the passenger. All unused services are non-refundable.

CRUISES:
Ship & Itinerary Changes: Cruise itineraries and ships are subject to change without notice. Furthermore, cruise ships may be chartered and/or departure dates canceled, in which case all monies will be refunded. Serenity Sand & Seas Travel takes no responsibility for ship substitutions or itinerary changes imposed by a cruise line and is not responsible for any losses you may incur including the issuance and/or cancellation of airline tickets or visa fees.

Medical Services: Many ships do not carry a doctor or nurse onboard. Should medical attention be required, local services will be contacted. Resulting charges will be the responsibility of the passenger. Serenity Sand & Seas Travel and the cruise ship operator are not responsible for the services provided.

Health Requirements: Check with your healthcare provider for up-to-date requirements. You may also check the Centers for Disease Control (www.cdc.gov) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by clients' health practitioner on a valid vaccination certificate which the client must carry for proof of inoculation where required. Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy, or mental illness should not participate in these rigorous travel programs. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour, will be removed from the group and directed to a local medical facility for diagnosis. Only upon clearance by an accredited medical facility will that individual be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary, will necessarily be borne by the passenger. Please note that some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. Luggage (Airlines): Checked bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26"+26"+10" = 62”), and a maximum weight of 50 lbs (23kg). Many airlines apply charges for checked bags. Serenity Sand & Seas Travel is not responsible for checked bag fees, excess luggage or weight charges levied by an airline. If your luggage is lost or damaged by the airlines, a baggage claim form MUST be filed with the carrier before leaving the airport. We recommend that you use brightly colored luggage tags, straps or other identifiers to help you locate your luggage upon arrival or to describe it if it is lost.



Luggage (Escorted Tours): All Serenity Sand & Seas Travel escorted tour buses allow one piece of luggage per person, plus carry-on bag. Additional baggage will be subject to a handling charge of $100 per piece. As Serenity Sand & Seas Travel will not be responsible for loss or damage to luggage and personal belongings, you MUST report any loss or damage immediately at the time of the incident and obtain a written report from the local authority for submission to your insurance provider.



PASSPORTS, VISAS, AND DRIVER’S LICENSES

  • You are responsible to be familiar with the laws and rules governing any travel to any country.
  • You are responsible to determine the documents needed, to acquire such documentation, and to ensure your passport is up to date and valid to enter or exit any country.
  • Agency may be able to assist you in acquiring the necessary travel documents upon your request.
  • However, Agency is not responsible or liable for your failure to hold visas or documentation or to determine the validity of your passport or any other travel document to enter or exit any country.


ENTRY REFUSAL

  • Countries may restrict entry for persons with criminal records.
  • You are responsible to understand all destination entry laws and to know if you or anyone in your party has a criminal record.
  • Agency does not inquire about Traveler criminal records in the interests of privacy.
  • Refusal of entry is not a valid reason for cancellation, chargeback, or refund.


TRAVEL DURING PANDEMICS, EPIDEMICS, AND OTHER TRAVEL ADVISORIES

  • You are solely responsible to be fully aware of any restrictions related to pandemics, epidemics, and other travel advisories.
  • You warrant that you have reviewed and understand all U.S. Center for Disease Control (CDC) and U.S. Department of State travel advisories, notices, warnings, restrictions, and rules, including those regarding pandemics, epidemics, COVID-19, and other health threats.
  • You are aware that certain countries, including the United States, may require testing and quarantine upon entering the country, as well as testing and quarantine upon returning to the United States or your country of residence.
  • You understand destination countries may have limited availability of tests required for return to the United States.
  • Screening procedures and restrictions may take place at airports and in public areas.
  • Restrictions may include mandatory face coverings and/or temperature checks in airports, hotels, cruise ships, trains, or other means of transport.
  • You are aware that immigration restrictions may be put in place before or during travel that could impede your ability to enter or exit your destination as planned.
  • All Travelers, including U.S. Citizens, should refer to current CDC guidelines, country-specific guidelines, and Supplier requirements regarding testing and documentation requirements.
  • If you fail to adhere to current regulations or provide any required testing results or documentation, you may be denied boarding, entry, or return to the United States or your country of residence.
  • You are responsible for continually checking the latest CDC and State Department travel advisories, which can be navigated via the following links:

  • CDC and other governmental notices and policies may change before your travel, during your travel, and after you return from travel.
  • Neither Agency nor Suppliers are responsible for Traveler testing or documentation.
  • You understand the inherent risks of choosing to travel.
  • You accept the risks set out above and hold Agency harmless against any travel restrictions, death, illness, cancellations by Suppliers, financial loss, quarantining rules, or measures put in place at airports or destinations you travel through.
  • You hold Agency harmless for any financial penalties or fees imposed by Suppliers for cancellations or postponements relating to COVID-19, pandemics, epidemics, natural disasters, accidents, or disturbances, or any similar events and you agree not to pursue any credit card charge-back, reimbursement, or legal action against Agency regarding such penalties or fees.


COVID-19 WAIVER OF LIABILITY

In Spring 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Center for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering and keeping at least 6 feet away from others. If contracted, this virus has the ability to cause the traveler serious and severe illness. For more information on the COVID-19 virus, please visit the CDC webpage at www.cdc.gov. I understand and agree to the following:

1. COVID-19 is a highly contagious virus that can be spread via person to person contact;
2. After reasonable inquiry, Serenity Sand & Seas Travel provided me with the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in my travel itinerary.
3. Supplier(s) of Serenity Sand & Seas Travel may have policies in place to help prevent the spread of COVID-19. Serenity Sand & Seas Travel is not the drafter or holder of those policies and I understand that these policies can change at any time;
4. I understand that the supplier(s) may not apply those policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate;
5. I understand that each state/country institutes their own pandemic protective policies and regulations. I further understand that I am responsible for knowing, understanding and abiding by the pandemic protective policies and procedures regarding COVID-19 of all state(s)/ country(ies) listed in my travel itinerary, including any policy updates. I also understand that I may be denied entry into the country for reasons within or outside of my control;
6. I understand that by traveling, I can be subject to voluntary or involuntary quarantine either at home or in the traveled location(s);
7. I am responsible for knowing, understanding and abiding by the pandemic protective policies and procedures regarding COVID-19 of all vendors used in my travel itinerary, including any policy updates;
8. With full awareness and appreciation of the risks involved, I, for myself, and on behalf of my traveling companions, including, but not limited to, my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release Serenity Sand & Seas Travel its officers, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with Serenity Sand & Seas Travel.
9. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of Serenity Sand & Seas Travel services, or the services of travel Serenity Sand & Seas Travels' suppliers or vendors, specifically related to COVID-19.

TRAVEL INSURANCE
  • Agency strongly recommends that each Traveler purchase comprehensive travel insurance.
  • If you decline to purchase travel insurance that includes coverage for medical needs while traveling and coverage for travel delays, you assume all personal risk and financial loss if you cancel your travel or incur costs or losses during the course of travel.
  • You understand that concerns or fear of pandemics or epidemics are not a covered reason under some travel insurance policies.
  • Insurance policies may exclude coverage for pandemics and epidemics.
  • Insurance claims will only be paid for covered matters, as stated in the insurance policy.
  • You hold Agency harmless for your election not to purchase travel insurance and for any denial of any claim by any insurer for any reason.


FORCE MAJEURE

  • No failure or delay in the performance of any obligation under these Terms will be a breach if such failure or delay arises from a force majeure or any cause beyond the reasonable and foreseeable control of Agency, including, without limitation, acts of God, floods, weather conditions, fires, explosions, accidents, war or threats of war (declared or undeclared), acts of terrorism, sabotage, insurrection, riots, strikes, or civil disobedience, sickness, epidemics, pandemics, quarantines, government interventions, defects in machinery or vehicles, delays or other events (collectively, “force majeure”).
  • Agency is not liable to you and will not provide any refunds caused by delay or non-performance of any obligation under these Terms to the extent any such delay is due to any force majeure.
  • If any Suppliers are affected by any force majeure, they may, in their sole discretion, vary or cancel any itinerary or arrangement in relation to your travel without notice.
  • If an accident occurs and you seek assistance from us, you will be responsible (financially and otherwise) responsible for all alternative travel arrangements.


LIMITATIONS OF LIABILITY

  • BECAUSE AGENCY ACTS AS AGENT FOR SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH SUPPLIERS, YOU AGREE THAT AGENCY IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF BOOKING SERVICES.
  • AGENCY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTIAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR SPECIAL DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY SUPPLIER BOOKING THROUGH US, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY THAT MAY BE INCURRED THROUGH THE FAULT, WILFUL ACTS, NEGLIGENCE, OMISSIONS, OR OTHERWISE OF SUCH SUPPLIER OR ITS EMPLOYEES, AGENTS, CONTRACTORS, OR REPRESENTATIVES, INCLUDING, BUT NOT LIMITED TO, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF TRAVEL SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY OR CESSATION OF OPERATIONS, AND ANY OTHER MATTERS OUTSIDE OF AGENCY’S CONTROL, AND YOU EXONERATE US FROM ANY LIABILITY WITH RESPECT TO THE SAME.
  • ANY RECOVERY BY YOU FROM AGENCY WILL BE LIMITED TO THE AMOUNT OF COMMISSIONS OR FEES ACTUALLY RECEIVED BY AGENCY FOR PROVIDING BOOKING SERVICES TO YOU DIRECTLY RELATED TO SUCH RECOVERY ON A CASE-BY-CASE BASIS.
  • AGENCY’S SOLE OBLIGATIONS AND LIABILITIES ARE AS STATED IN THESE TERMS. ALL OTHER REPRESENTATIONS OR WARRANTIES—EXPRESS OR IMPLIED, BY STATUTE, LAW, OR OTHERWISE—ARE EXCLUDED.


ARBITRATION

  • In case of a dispute between the you and Agency relating to or arising out of these Terms, we will first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, then we will submit the dispute to binding arbitration.
  • The arbitration shall be conducted as follows:
o State of North Carolina, County of Nash.
o The arbitration shall be conducted by a single arbitrator, and such arbitrator shall have no authority to add parties, vary the provisions of these Terms, award punitive damages, or certify a class.
o The arbitrator shall be bound by applicable and governing federal law as well as the law of the State of North Carolina, County of Nash.

  • Each party shall pay their own costs and fees.


GENERAL

  • Amendments. These Terms may be amended only in writing by Agency.
  • Assignment. You may not assign any right or obligation under these Terms without Agency’s prior written consent, which will not be unreasonably withheld or delayed.
  • Waiver. No forbearance or delay in enforcing these Terms will prejudice or restrict any rights of you or Agency. No waiver of a right will operate as a waiver of any subsequent right. No right is exclusive of any other right, and each right is cumulative.
  • Severability. If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted by law and the remainder of these Terms will remain fully in force.
  • Relationship of Parties. These Terms do not create an agent relationship, legal-entity partnership, joint venture, or employment relationship between you and Agency. You have no authority to bind Agency or incur any obligation on Agency’s behalf.
  • Notices. Notices under these Terms will be in writing and deemed given when sent to the receiving party’s email or other address provided for purposes of notice.
  • Counterparts. These Terms may be signed or accepted electronically in more than one counterpart; each will be an original. Counterparts together constitute a single instrument.
  • GoverningLaw. These Terms are governed exclusively by the laws of North Carolina without regard to conflicts of law provisions.
  • Further Assurances. You and Agency will perform any additional acts as necessary to effect these Terms and will address together in good faith any unforeseen issues that arise under these Terms with a view to mitigating any material adverse impact on either party.
  • Entire Agreement. These Terms, together with the Travel Services Agreement, is the entire agreement between you and Agency and supersedes all prior agreements, written or oral, between us regarding its subject matter.
